  19.              ADMINISTRATION OF PROLIFERATION SANCTIONS,
  20.         MIDDLE EAST ARMS CONTROL, AND RELATED CONGRESSIONAL
  21.                      REPORTING RESPONSIBILITIES
  22.   
  23.        By the authority vested in me as President by the 
  24.   Constitution and the laws of the United States of America, 
  25.   including section 301 of title 3, United States Code; 
  26.   sections 1701-1703 of the National Defense Authorization Act 
  27.   for Fiscal Year 1991, Public Law 101-510 (50 U.S.C. App. 2402 
  28.   note, 2405, 2410b; 22 U.S.C. 2797-2797c); sections 303, 324, 
  29.   and 401-405 of the Foreign Relations Authorization Act, Fiscal 
  30.   Years 1992 and 1993, Public Law 102-138; sections 305-308 of 
  31.   the Chemical and Biological Weapons Control and Warfare 
  32.   Elimination Act of 1991, Public Law 102-182 (50 U.S.C. App. 
  33.   2410c; 22 U.S.C. 2798, 5604-5606); sections 241 and 1097 of 
  34.   the National Defense Authorization Act for Fiscal Years 1992 
  35.   and 1993, Public Law 102-190; and section 1364 of the National 
  36.   Defense Authorization Act for Fiscal Year 1993, Public 
  37.   Law 102-484, I hereby order as follows:  
  38.   
  39.        Section 1.  Chemical and Biological Weapons Proliferation 
  40.   and Use Sanctions.  (a)  Chemical and Biological Weapons 
  41.   Proliferation.  The authority and duties vested in me by 
  42.   section 81 of the Arms Export Control Act, as amended ("AECA") 
  43.   (22 U.S.C. 2798), and section 11C of the Export Administration 
  44.   Act of 1979, as amended ("EAA") (50 U.S.C. App. 2410c), are 
  45.   delegated to the Secretary of State, except that:
  46.   
  47.        (1)  The authority and duties vested in me to deny 
  48.             certain United States Government contracts, as 
  49.             provided in section 81(c)(1)(A) of the AECA and 
  50.             section 11C(c)(1)(A) of the EAA, pursuant to a 
  51.             determination made by the Secretary of State under 
  52.             section 81(a)(1) of the AECA or section 11C(a)(1) 
  53.             of the EAA, as well as the authority and duties 
  54.             vested in me to make the determinations provided for 
  55.                in section 81(c)(2) of the AECA and section 11C(c)(2) 
  56.             of the EAA are delegated to the Secretary of Defense.  
  57.             The Secretary of Defense shall notify the Secretary 
  58.             of the Treasury of determinations made pursuant to 
  59.             section 81(c)(2) of the AECA and section 11(c)(2) of 
  60.             the EAA.

  62.        (2)  The authority and duties vested in me to prohibit 
  63.             certain imports as provided in section 81(c)(1)(B) 
  64.             of the AECA and section 11C(c)(1)(B) of the EAA, 
  65.             pursuant to a determination made by the Secretary 
  66.             of State under section 81(a)(1) of the AECA or 
  67.             section 11C(a)(1) of the EAA, and the obligation to 
  68.             implement the exceptions provided in section 81(c)(2) 
  69.             of the AECA and section 11C(c)(2) of the EAA, insofar 
  70.             as the exceptions affect imports of goods into the 
  71.             United States, are delegated to the Secretary of the 
  72.             Treasury.

  80.        (b)  Chemical and Biological Weapons Use.  The authority 
  81.   and duties vested in me by sections 306-308 of the Chemical and 
  82.   Biological Weapons Control and Warfare Elimination Act of 1991 
  83.   (22 U.S.C. 5604-5606) are delegated to the Secretary of State, 
  84.   except that:
  85.   
  86.        (1)  The authority and duties vested in me to restrict 
  87.             certain imports as provided in section 307(b)(2)(D), 
  88.             pursuant to a determination made by the Secretary of 
  89.             State under section 307(b)(1), are delegated to the 
  90.             Secretary of the Treasury.
  91.   
  92.        (2)  The Secretary of State shall issue, transmit to the 
  93.             Congress, and notify the Secretary of the Treasury 
  94.             of, as appropriate, waivers based upon findings made 
  95.             pursuant to section 307(d)(1)(A)(ii).
  96.   
  97.        (3)  The authority and duties vested in me to prohibit 
  98.             certain exports as provided in section 307(a)(5) and 
  99.                section 307(b)(2)(C), pursuant to a determination made 
  100.             by the Secretary of State under section 306(a)(1) and 
  101.             section 307(b)(1), are delegated to the Secretary of 
  102.             Commerce.
  103.   
  104.        (c)  Coordination Among Agencies.  The Secretaries 
  105.   designated in this section shall exercise all functions 
  106.   delegated to them by this section in consultation with the 
  107.   Secretary of State, the Secretary of Defense, the Secretary of 
  108.   the Treasury, the Secretary of Commerce, the Director of the 
  109.   Arms Control and Disarmament Agency, and other departments and 
  110.   agencies as appropriate, utilizing the appropriate interagency 
  111.   groups prior to any determination to exercise the prohibition 
  112.   authority delegated hereby.
  113.   
  114.        Sec. 2.  Missile Proliferation Sanctions.  (a) Arms 
  115.   Export Control Act.  The authority and duties vested in me by 
  116.   sections 72-73 of the AECA (22 U.S.C. 2797a-2797b) are delegated 
  117.   to the Secretary of State, except that:
  118.   
  119.        (1)  The authority and duties vested in me by 
  120.             section 72(a)(1) to make determinations with 
  121.             respect to violations by United States persons of 
  122.             the EAA are delegated to the Secretary of Commerce.
  123.   
  124.        (2)  The authority and duties vested in me to deny certain 
  125.             United States Government contracts as provided in 
  126.             sections 73(a)(2)(A)(i) and 73(a)(2)(B)(i), pursuant 
  127.             to a determination made by the Secretary of State 
  128.             under section 73(a)(1), as well as the authority 
  129.             and duties vested in me to make the findings provided 
  130.             in sections 72(c), 73(f), and 73(g)(1), are delegated 
  131.             to the Secretary of Defense.  The Secretary of State 
  132.             shall issue, transmit to the Congress, and notify the 
  133.             Secretary of the Treasury of, as appropriate, any 
  134.             waivers based upon findings made pursuant to 
  135.             sections 72(c) and 73(f).

  137.        (3)  The authority and duties vested in me to prohibit 
  138.             certain imports as provided in section 73(a)(2)(C), 
  139.             pursuant to a determination made by the Secretary 
  140.             of State under that section, and the obligation to 
  141.             implement the exceptions provided in section 73(g), 
  142.             are delegated to the Secretary of the Treasury.

  148.        (b)  Export Administration Act.  The authority and duties 
  149.   vested in me by section 11B of the EAA (50 U.S.C. App. 2410b) 
  150.   are delegated to the Secretary of Commerce, except that:
  151.   
  152.        (1)  The authority and duties vested in me by 
  153.             sections 11B(a)(1)(A) (insofar as such section 
  154.             authorizes determinations with respect to violations 
  155.             by United States persons of the AECA), 11B(b)(1) 
  156.             (insofar as such section authorizes determinations 
  157.             regarding activities by foreign persons), and 
  158.             11B(b)(5) are delegated to the Secretary of State.

  160.        (2)  The authority and duties vested in me to make the 
  161.             findings provided in sections 11B(a)(3), 11B(b)(6), 
  162.             and 11B(b)(7)(A) are delegated to the Secretary of 
  163.             Defense.  The Secretary of Commerce shall issue, 
  164.             transmit to the Congress, and notify the Secretary of 
  165.             the Treasury of, as appropriate, waivers based upon 
  166.             findings made pursuant to section 11B(a)(3).  The 
  167.             Secretary of State shall issue, transmit to the 
  168.             Congress, and notify the Secretary of the Treasury 
  169.             of, as appropriate, waivers based upon findings made 
  170.             pursuant to section 11B(b)(6).

  172.        (3)  The authority and duties vested in me to prohibit 
  173.             certain imports as provided in section 11B(b)(1), 
  174.             pursuant to a determination by the Secretary of State 
  175.             under that section, and the obligation to implement 
  176.             the exceptions provided in section 11B(b)(7), are 
  177.             delegated to the Secretary of the Treasury.

  179.        (c)  Reporting Requirements.  The authority and duties 
  180.   vested in me to make certain reports to the Congress as provided 
  181.   in section 1097 of the National Defense Authorization Act for 
  182.   Fiscal Years 1992 and 1993 and section 1364 of the National 
  183.   Defense Authorization Act for Fiscal Year 1993 are delegated to 
  184.   the Secretary of State.
  185.   
  186.        (d)  Coordination Among Agencies.  The Secretaries 
  187.   designated in this section shall exercise all functions 
  188.   delegated to them by this section in consultation with the 
  189.   Secretary of State, the Secretary of Defense, the Secretary of 
  190.   the Treasury, the Secretary of Commerce, the Director of the

  196.        Sec. 3.  Arms Control in the Middle East.  The 
  197.   certification and reporting functions vested in me by 
  198.   sections 403 and 404 of the Foreign Relations Authorization 
  199.   Act, Fiscal Years 1992 and 1993, are delegated to the Secretary 
  200.   of State.  The Secretary of State shall exercise these functions 
  201.   in consultation with the Secretary of Defense and other agencies 
  202.   as appropriate.

  204.        Sec. 4.  China and Weapons Proliferation.  The reporting 
  205.   functions regarding China and weapons proliferation vested in 
  206.   me by sections 303(a)(2) and 324 of the Foreign Relations 
  207.   Authorization Act, Fiscal Years 1992 and 1993, are delegated to 
  208.   the Secretary of State.  The Secretary of State shall exercise 
  209.   these functions in consultation with the Secretary of Defense 
  210.   and other agencies as appropriate.

  218.        Sec. 5.  Arrow Tactical Anti-Missile Program.  The 
  219.   authority and duties vested in me to make certain certifications 
  220.   as provided by section 241(b)(3)(C) of the National Defense 
  221.   Authorization Act for Fiscal Years 1992 and 1993 are delegated 
  222.   to the Secretary of State.
  223.   
  224.        Sec. 6.  Delegations.  The functions delegated herein may 
  225.   be redelegated as appropriate.  Regulations necessary to carry 
  226.   out the functions delegated herein may be issued as appropriate.
  227.   
  228.        Sec. 7.  Priority.  This order supercedes the Memorandum 
  229.   of the President, "Delegation of Authority Regarding Missile 
  230.   Technology Proliferation," June 25, 1991.  To the extent that 
  231.   this order is inconsistent with any provisions of any prior 
  232.   Executive order or Presidential memorandum, this order shall 
  233.   control.
